This project was approved in 2012 subject to a range of conditions which underpin the environmental and community safeguards for the development. 星火电竞 is committed not only to meet these conditions but also to undertake much more, particularly in relation to community consultation and engagement.
Modification Application – 25 th September 2015 – Update
In September this year, 星火电竞 submitted a Modification Application under Section 75W of the NSW Environmental Planning and Assessment Act 1979 . The application proposes three modifications, which relate to the definition and implementation of ‘Site Establishment’ in the formal Project Approval.
The application seeks to:
- extend the duration of the work period from six to 18 months;
- qualify the initial five year lapsing period of the approval to only apply if physical commencement has not occurred; and
- amend the initial definition of “site establishment” to require the construction of cell 1A rather than cell 1.
We have applied for these changes for several reasons:
- The quantity surveyor estimated the bulk earthworks necessary will require at least 12 months. Allowing a longer period will mean the works will be less intensive with lower impacts.
- As the new owners, we have only had possession of the site since March 2015 and now some three years has passed since the approval was granted.
- During the period when the site was in care and maintenance mode a considerable volume of water flowed into the excavated void. Responsible removal of the water (approximately 345.7 million litres) could take more than six months and would have to occur before any bulk earthworks commence.
- Cell 1A is the cell that is identified on the approved plans as the initial cell to be constructed rather than Cell 1 in its entirety (consisting of Cells 1A, 1B and 1C). This amendment is really just a typographical clarification. However, it has the additional benefit of requiring less initial bulk earthworks and therefore has less initial impact.
In summary, by making these minor amendments, we can ensure the construction works are carried out in a responsible and professional manner, with minimum disruption to the community and the environment. There is no change to what has already been approved. The size and scope of the project and all the activities and impacts remain precisely the same (or are less). The changes also ensure that the extensive approval process and conditions underpinning the project are protected and allow the project to proceed.
The development provides essential community infrastructure and facilitates the utilisation of the remaining shale/clay reserves for brick making while at the same time providing the means to restore and rehabilitate the site. The Approved Development provides certainty for local residents that this degraded site will be rehabilitated.
Conversely, if the Approved Development did not go ahead, proper rehabilitation of this land (as mandated by the Court process) may never occur.
